Please read these Terms of Use (“Terms”) carefully before using borahfieldworks.com (the “Site”) or requesting services from Borah Fieldworks LLC (“Borah Fieldworks,” “we,” “us,” or “our”). By using this Site or submitting the contact form, you agree to these Terms.

1. Use of This Site

You may use this Site to learn about our services and to contact us regarding field scans, field analysis, or technical design and fabrication support. You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site
  • Scrape, copy, or reproduce the Site’s content without permission
  • Impersonate any person or misrepresent your affiliation with any farm, operation, or entity when contacting us

2. Contact Form Submissions

Submitting the contact form does not create a client relationship, service agreement, or any binding obligation between you and Borah Fieldworks. Any actual services (such as a field scan, field optimization review, or technical design and fabrication support) will be governed by a separate written agreement between you and Borah Fieldworks.

Information you submit through the contact form is not confidential and should not include sensitive information beyond what is necessary to describe your inquiry.

3. Nature of Our Services

Borah Fieldworks provides drone-based field scanning, aerial and multispectral field analysis, and practical technical design and fabrication support (including 3D-printed parts and prototypes) to agricultural operations.

Borah Fieldworks does not provide licensed professional engineering services. Nothing on this Site or in our services constitutes a professional engineering opinion, stamped design, or work product requiring a licensed Professional Engineer. Any parts, prototypes, or fabricated components we provide are delivered as finished physical products for your evaluation and use, not as certified engineering designs.

Any technical design or fabrication work is provided on an “as-is” basis. You are solely responsible for evaluating the fitness, safety, and suitability of any part, prototype, or fabricated component for your specific application before use.

4. Disclaimer of Data Accuracy

Aerial imagery, multispectral analysis, action maps, and any related findings we provide are intended to help prioritize where to focus your attention and scouting efforts. They are provided “as is” and “as available,” without warranty of accuracy, completeness, or fitness for a particular purpose.

Field conditions, crop health, and agricultural outcomes are influenced by many factors beyond what aerial or multispectral data can capture. You are solely responsible for any decisions made regarding your crops, irrigation, equipment, or operations, and we recommend confirming significant findings through your own ground observation or with a qualified agronomist before acting on them.

5. Drone Operations

Our drone flights are conducted in accordance with applicable Federal Aviation Administration (FAA) regulations, including 14 CFR Part 107. We reserve the right to reschedule, delay, or decline a flight due to weather, airspace restrictions, safety concerns, or other operational factors.

6. Limitation of Liability

To the fullest extent permitted by law, Borah Fieldworks LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of crops, loss of profits, or loss of data, arising out of or related to your use of this Site or our services, even if we have been advised of the possibility of such damages.

Our total liability arising out of or related to your use of this Site or our services shall not exceed the amount you paid to Borah Fieldworks for the specific service giving rise to the claim.

7. Indemnification

You agree to indemnify and hold harmless Borah Fieldworks LLC from any third-party claims, losses, or damages arising from your misuse of any information, findings, parts, or prototypes provided by us, or your violation of these Terms.

8. Privacy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

The Borah Fieldworks name, logo, and all original content on this Site are the property of Borah Fieldworks LLC and may not be reproduced without permission.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Kootenai County, Idaho.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
